Florida Woman Accused of Shooting Officer Serving Warrant
AmmoLand ^ | 29 December, 2020 | Dean Weingarten

On 28 September 2020, a warrant was served in Jacksonville Florida, just before 8 a.m. The warrant was not a no-knock warrant. There is evidence the officers serving the warrant attempted to announce themselves with loudspeakers and by knocking. The warrant was served by a Special Weapons And Tactics (SWAT) team and the DEA. When they did not get an answer, they started to break in. They were not wearing body cameras.

Diamonds Ford started shooting at them. She hit one officer in his vest, which saved him from a bullet wound. She called 911 and told the operator her home was being attacked.

Operator: “Ma'am give me the name of the street.'

Ford: “7232 Rutledge. Please Hurry.

 Operator: “What's happening?”

Ford: Someone is shooting.

Ford: “We gonna die.”

Operator: “7232 Rutledge Pearson Drive, do you know who is shooting?”

JSO: “Open the front door.”

Ford:  “Oh wait, what, wait, that's the sheriff's office. Okay hey hey hey, hold on, wait wait wait, hold on wait, whoa.”

There is more on the video. This partial transcript gives you the flavor.

It is hard to deceive convincingly, on the spur of the moment. Diamonds Ford sounds very convincing.

Ford says she and her fiancee were sleeping, awoke to the sound of breaking glass, and she fired at the presumed home invaders.

In the United States, people prize their Second Amendment rights. Their home is their castle. People serving warrants need to take special care.

A warrant announcement that is not heard, is equivalent in effect to a no-knock warrant. One troubling aspect of the raid – no officers wore body cameras. Some neighbors say they were sleeping as well and did not hear the announcement.

I don't understand why cops can't just camp outside and wait for the citizen to exit.

Two days ago, I woke up to a white SUV parked in front of my Phoenix home, engine running. There for at least an hour. A while later, a marked SUV was across the street and half a dozen police (one female) were there quietly apprehending two people on arrest warrant. We only knew it was a big one when behind the back cuffs were placed. When I asked one of the police what was going on, he volunteered that he was only executing a warrant, and I could go about my business (I wanted to run errands, and make sure my wife and children were safe).

In an urban neighborhood like mine, the risk is too great to risk escalating the confrontation.

In defense of the deputies in this case:

1. It was not a no-knock raid. They announced with loudspeakers and by knocking before serving the search warrant.

2. The police never fired any shots, or threw any flash bang grenades.

3. When fired on, the deputies responded by another announcement, saying who they were.

4. They had surveilled the residence for some time to obtain a valid warrant.

5. They took the couple into custody with out beating, severely injuring, or killing them.

6. The warrant was served during daylight hours.

In defense of Diamonds Ford and her fiancee:

1. It is highly plausible they did not hear the police announce, before the police started to break in.

2. Diamonds stopped shooting as the threat stopped.

3. Diamonds and her fiancee immediately complied when they announcement was made after the attempted break-in.

4. Diamonds and fiancee only had minor police records before this event.

--------------------------------------------------------------------------------------

Finally, lots of criminals announce they are the police, in order to facilitate their crimes.

[Ten years ago, I would have taken the cops’ word for it that they announced themselves loud enough. Now I know that some cops lie. ]

For someone with a long rap sheet that includes violent felonies, it’s probably good enough. But when the occupant is guilty, at worst, of non-violent misdemeanors. Ultimately, any PD that doesn’t mandate bodycams is asking for trouble. That is especially the case with racial quotas that jam less-qualified applicants into the force solely on the basis of race or ethnicity, despite lower test scores. Unfortunately, test scores have been linked to how closely people stay on the straight and narrow. That’s why people get an auto insurance discount for having graduated college. It’s one of the few forms of insurance pricing on the basis of demographic risk profile that’s still legal.

Exactly! Body cameras have become so cheap that now everyone that buys a body camera gets a phone for free. Yep! Every phone has a camera and just about every American has a phone. Obama made sure of that with his free “Obama phones” that aren’t free. If a law enforcement agency cannot afford a body camera for all of their employees that serve warrants and make arrests, then provide one for those that do.

What is so critical about the predawn raids anyway. This woman is sitting in jail charged with possession of pot that is now becoming legal in more and more states. This was the root cause of the raid. What were the LEOs expecting to find at her house? Could it have possibly been anything that warranted risking the lives of officers to find out in the dark of night? Someone should ask those that got shot at.

Cops are as much civilians as the citizens they allegedly “protect by and serve”, self serving police delusions to the contrary notwithstanding.

It is possession of marijuana with intent to distribute, so not simple possession.

...........or just turn power and water off. They’ll leave a lot faster if that happens.

I think too that a No Knock warrant needs to include in it a finding by the judge issuing it that the individual being sought is an “immediate and direct and serious danger to the public”.

That name of the home resident: Diamonds Ford.
Sounds like a character in some Film Noir mystery starring Humphrey Bogart.

Thank you for posting the photos. According to the new rules, based on the color of the defendant, shooting the police was self-defense.

Get used to it.

Police unions resist rules requiring cameras for that reason.

......................................................

My son’s 65 member p.d. couldn’t get the city council to spring for body cams. so the union bought one for every member. This was about ten years ago and the union has continued to replace them as needed.

They protect cops too. Do you have some examples where unions fought their use?

Going forward, no bodycam may come to mean no knock, with consequences for the viability of charges levied against home occupants who fire at cops entering the premises by force.

If you're ever on a jury, you can help to enforce that. For myself, I could never vote to convict in such a circumstance. Police need to become a part of civilized society again. If they want to act like an occupying army, we'll treat them as such.

We’ll be seeing this kind of pseudo-no-knock every day in the coming years...
