Vice President Mike Pence asked a federal judge in Texas to deny a Republican congressman’s emergency request for a court order that would essentially allow the vice president to reverse Donald Trump’s election loss during a joint session of Congress Wednesday.
Rep. Louie Gohmert of Texas should have sued the U.S. Senate or the House of Representatives if he disagrees with the established way that Electoral College votes are counted, Justice Department attorneys representing Pence said in a filing Thursday.“The vice president -- the only defendant in this case -- is ironically the very person whose power they seek to promote,” the government said.
“The Senate and the House, not the vice president, have legal interests that are sufficiently adverse to plaintiffs.”Gohmert argues Pence can hand Trump a second term by simply rejecting swing states’ slates of Democratic electors and instead choosing competing GOP electors when the Senate and House meet jointly to open and count certificates of electoral votes. Election experts have said such a finding would create a major conflict of interest.
The House asked for the judge’s permission to file its own brief, in which it argues Gohmert is trying to “upend” Congress’ longstanding role in counting the votes of the Electoral College and invalidate the Electoral Count Act, which has governed the process since 1887.“The House also has a compelling interest in ensuring that the public’s confidence in the processes for confirming the results of the 2020 presidential election is not undermined by this last-minute suit, which would authorize the vice president to ignore the will of the nation’s voters,” House attorneys said in the request.In another filing Thursday, Colorado elector Alan Kennedy argued Gohmert’s lawsuit is based on flawed legal arguments and debunked claims of election fraud.

So, if the law is unconstitutional, how can anyone ask a judge to ignore it. The judge has no choice but to listen to the Constitution and not the defendant.
Gosh, I sure hope the president doesn’t have to lock up his own V.P. as well as the rest of the Deep State.

It’s been four years with no indictments of anyone notable. The deep state is winning.

I, for one, am sick of the two tiered “justice” system...
Rep. Louie Gohmert is in error. The President of the Senate (VP Pence) has a very specific and enumerated duty in the 12th amendment. That is to open all the certificates and count them.
The counting of those slates of electors may be challenged under existing law. If challenged, the different houses meet and vote to determine if they will accept the slate of electors or not. The Vice President does not make the determination as to what is counted.
There are a couple of ways to look at this.
The Louie Gohmert way, obviously.
But the other way is that Pence has known for two months that he would be put in this spot. He has lawyers who have worked on the problem for probably the entire two months. From what I have read, they take the position that the Constitution does not allow the VP to decide who will be president.
Add to that Pence is no cowboy.
There is a lot of pressure now that was not evident even a few weeks ago on the part of important politicians in the states under discussion. There is a good chance they will find a way to with draw their confirmation of Biden,
Wait until we hear from Pence. A lot will happen on January 6 and Pence will not be the only show pony.
As for McConnell....a snake in the grass.
You just have to love that word: “debunked”. Without any specifics, it is the end of all argument, as far as liberals are concerned to any logical argument.
There are two problems. First, under separation of powers means the legislature can't use the courts to tell the executive how to directly administer its authority regarding interaction with the legislature before the legislature acts. Second, Gohmert and the Administration are the same political party. This is like suing yourself to get a ruling against someone else, without actually suing the other party. The courts don't go for those kind of suit.
Heard Gohmert interviewed tonight and he said it’s nothing more than a declaratory ruling that is sought It makes sense that the 19th century rule was unconstitutional.
Other than that I am not hopeful Pence will do the right thing.
We need a couple of legislatures to turn this around. Things are moving in that direction but time is short.
Congress can in fact agree to postpone Jan 6 but ... fat chance especially with McConnell and his penchant to sit with a do-nothing establishment. He did the same to the Tea Party movement.
Things look bleak.

But there is no enforcement.
People do here the real news, they get it in many different ways, even worldwide, people see the truth of what happened.
But because the proof is not broadcast on establishment news (old MSM), the Establishment itself things it’s not newsworthy. The Swamp and its political establishment think if it’s not on their corporate news channels, it didn’t happen. Soo they continue to act glib. Angry constituents are turning some around.
Pence is just another brick in the wall of the Deep State.

When he was governor of Indiana, he caved to protests from the homosexual lobby and agreed to legislation that watered down a religious rights measure that he had just signed into law, so I'm not holding my breath that he has the fire in the belly to go to the mat to save the Trump administration--and America.
Sidney Powell claims to have an enormous amount of evidence of fraud. If SCOTUS won’t give a hearing, she should have a mock hearing and presentation of the evidence in front of the Supreme Court and stream it live.

IMO As long as the “deep state shadow government” remains unscathed and in place, of which I surmise VP Mike Pence is and has been a member, it’s obvious that this country will continue to go the way of an aristocratical type communist state unless and until it is thrown off.
