Pence has a point, Gohmert is trying to side step the house to order Pence to act in a way that hasn't come up yet. This is a member of the legislature using the courts to tell a member of the executive how to act in a situation that has yet to happen. Under separation of powers, the U.S. government does not work that way.

This is not to say that under separation of powers and court precedent state legislatures and the courts should not have already acted and made a lot of noise about it.

This court shouldn’t be involved here. Our Constitution is clear as to VP Pence’s duty on January 6th. We don’t need a federal judge to muck it up at this point.

I agree with the argument that the VP should not be able to reject whatever state submissions of electoral votes he disagrees with. That places too much power in one person.

I am hoping to see House and Senate members object to the questioned state’s votes. And those votes referred to the House and Senate for debate and vote.

I think that any state that obstructed observation should be overturned and made an example that you don’t conceal your election process. That more than sufficient votes can be shown to be fraudulent or at least in doubt, is extra motive to throw out those state’s votes.

But I would also be careful against setting a precedent that could be turned against us in the future. If precedent became that a state automatically got overturned for a non-transparent process. Then you would have democratic operatives blocking transparency in Republican states.

You need to have faith. If Pence had really defied Trump, Trump would be on Twitter unloading on Pence. But he isn't. Pence is positioning his pieces for the correct line of attack.

Folks, it’s done. It’s Trump vs the entire world with no help from anyone. It’s been done since SCOTUS rejected that excellent Texas case. Some Senators or Reps going around saying they’re going to object or some shit isn’t going to change anything. It’s obviously just some last minute theater. Almost everything out of the GOP is theater.

Biden successfully stole the election. It’s done.

We need to start looking towards our next move. That next move isn’t “oh, we’ll just vote ourselves back into power,” because that’s done too. It’s gone with the wind.

Could be SCOTUS decision at some point but a federal judge in Texas should not have the power to tie Pence’s hands. At least that’s the way I see it.

I fully expect Trump to be inaugurated for 2nd term. It’s going to be clear to us how and why but the left is going to explode.

Courts adjudicate controversies between adverse parties. They don’t have jurisdiction to use a “friendly” lawsuit as a sham to issue an advisory opinion, which is exactly what Gohmert was asking the judge to do.

Pence will not leave as his historical legacy the overturning of an election regardless of the level of fraud. He may be a Christian he may not. He may be a good man an then again he may not. Nothing in DC is what it seems. Nothing in politics is what it seems. Pence is far more worried about his legacy and image. This makes me wonder about how much of a Christian he is. He will turn over the country to secular globalists rather then keep in office the most pro-religious freedom President in recent history.

The Vice President has zero power or authority to challenge the validity of the Electors. He merely opens and presides over the counting of the votes in the presence of Congress. That’s it.

Anyone who says otherwise is blowing smoke at best.
