The Justices area of responsibility is the Constitution and stare decisis. They are not responsible for deterring riots. Deterring riots falls to law enforcement and perhaps the military.

So should stare decisis be respected when the SCOTUS starting eroding that swiftly in the 1930s and when the Warren court further kicked the erosion into overdrive which is where we are now or ignoring stare decisis and fixing what the court did that eroded stare decisis in the first place?
