Your mistake is thinking logic is involved at all. You’re dealing with people who think “military tribunals” are even a possibility, when the Supreme Court burst that bubble over 150 years ago in Ex Parte Milligan. This is fantasy, not logic.
You mistake is thinking the Supreme Court or any other court matter if martial law is in place, every dictator came to power the same way. On the other hand I would rather have Trump as a dictator than the current crop of progressives.
