In this analysis Graham Allison lays out the path by which Pence opens the electoral college votes in the joint session of the house and senate, contests certain states, and when the house and senate differ on whether to accept the votes, he decides the tie as the presiding officer. This leads to the house of representatives.

Graham Allison at the Balfour Center of the Kennedy School of Government is arguably the only uncucked member of the Harvard faculty and is worth listening to.

Dunno. Anything is possible. Even if one isn’t much of a praying person, it certainly does no harm to do so. Will watch developments with great interest.

I was led to this article by an excelellent Twitter thread by Eyeconchick which goes as follows:

1. The Stage - The legal effort - Make no mistake that Sydney Powell, Rudy Giuliani, Lin Wood, Ted Cruz and the Texas AG are quite familiar with standing. They knew they had little to no chance of the cases being heard, and even less chance of favorable relief.

2. The BIG one - The Texas SCOTUS filing - This case was 50/50 on standing but it wouldn't have offered relief. The Justices Trump appointed had no issue dismissing the case and deferring power back to the state legislatures. The reason will become clear in just a moment.

3. The Reason - The various court filings were never meant to prevail. Their only purpose was to inform the pubic. It allowed people see the fraud. The actual filing docs allowed Anons to read and share so that people could see the problems with our elections.

4. The Fire Fire - MSM and the trolls continue to assist in Trump's path to victory. They only fuel theFire when they ignore or antagonize Republicans. Why is that a good thing? Every pissed off Republican is another call to Congress reps and senators demanding action.

5.The calls matter! Why? Republicans know that Trump is the way to the Republican voters' hearts. When the media tried to shame Trump for overshadowing the senators in the GA rally - they basically provided incentive for every Republican to have Trumps back instead.

6. The Election Rejection - On January 6th Congress will convene to count the electoral votes. At this time the sitting VP, Mike Pence, has the ability to challenge by refusing to accept the votes from states in which he believes the vote was compromised. Which - he will do.

7. The Second Vote - As directed by the US Federal constitution - a challenged election is settled by a simple majority house vote by ballot. However, the house gets one vote per state not per representative - Giving Trump the Republican majority 26-23 (or 22). Winner takes all.

8. The Appeal - Democrats will panic and immediately appeal this decision to SCOTUS. But SCOTUS having set a very clear legal precedent that the power lies with the state legislatures - will again - dismiss the case on standing.

9. The Democracy Hypocrisy - Dems and MSM will call Trumps actions unprecedented, claiming irrevocable damage to our Democracy. Except - Biden honored the EXACT same challenge attempted by Democrats in 2016. In which the house majority voted in favor of Trump.

10. Checkmate - Sauce in form of links to follow: Link 1 was written by a Harvard Government Professor who figured this out way before me [the subject article of AJ's post above] Link 2 outlines the Dem challenge on Jan 6th 2016.

Very helpful layout of the process and reasons.

I’m not convinced that Pence has ultimate authority, although they make a good case.

My problem?
“the President of the Senate decides authoritatively what ‘certificates’ from the states to ‘open’ and thus what electoral votes are ‘to be counted.’” “
But the language doesn’t give him that decision- it says he shall open “ALL” of them. Which implies he has no choice.
Anyway, a very helpful read.
I hope our state legislatures get the proof they need to act.

Point 6. I hope Pence actually has the stones to reject the votes from the corrupt states when that day arrives.

There are errors with this. The big one is #6 as VP Pence has no say in which electors are received and which ones are rejected. Hs only role is to preside over the vote count and then announce the tally. Since #6 cannot happen as described, steps 7, 8, 9, and 10 are moot.

Step #4. Republican controlled legislatures in swing states that went for Biden have not been under any pressure as shown by the fact they have no interest in naming a slate of electors who would vote for Trump. Some have held official and unofficial hearings but we’ve seen that don’t do anything.

Step #4. Very few Republicans in Congress have come out and publicly stated that Trump has won the election. And there a few Republicans in Congress who have publicly declared that Biden won the election.

I fundamentally have a problem with point #3. My view is that the SC had a clear choice. Per the never read article VII the Constitution is a compact between the sovereign states who as all parties to a contract have the right to enforce the contract when another party breaches it, and the SC per Article III "shall have" original jurisdiction to resolve disputes between the states.

The SC is derelict in its duties under the US Constitution.

The House reviewed the Electoral College ballots, threw them out, and then the House voted for Trump??

I am not going to presume what Pence will or will not do. But I have been astonished by Pence’s toughness and tenacity every time I have seen him speak. Had he debated Bedtime for Biden it would have been ByeBye. Trump is a lot of things, but great debater he is not. He bludgeons his opponent to death. It works. But it’s not debating.
