Supreme Court's Texas Ruling is Nothing Short of Disgrace

Friday evening the United States Supreme Court decided to not take the Texas lawsuit against four states over their application of presidential election law. The Court only mustered two justices in favor of taking the case: Samuel Alito and Clarence Thomas. The argument against hearing the case was that Texas lacked standing to sue Michigan, Georgia, Wisconsin, and Pennsylvania. Wow!

In a podcast titled “Is Secession Upon Us?” Ben Shapiro argued against the Supreme Court taking the Texas lawsuit. He reasoned that under principles of federalism it would threaten our union if the sovereign states could dictate the laws of other states without resulting direct damages. This goes to one of the three principles of legal standing. His concern considers that in the future, the Court under a left-leaning majority would use this concept to attack more conservative states and their laws. His thinking is reasonable and likely figured into a rejection of the case by the seven other justices. Yet, I doubt that this was the essential point in this case.

If we examine Marbury v. Madison (1803), Chief Justice John Marshall set the principle of judicial review of congressional laws. He determined that Section 13 of the Judiciary Act of 1789 violated Article III of the Constitution by illegally enlarging the role of the Supreme Court from an appellate jurisdiction to one of original jurisdiction. His reasoning was excellent. But one must also consider the political implications. President Thomas Jefferson, an ardent opponent of last-minute appointments made by the John Adams administration, would likely refuse to obey a writ of mandamus to sit Marbury as a judge, rendering the Court impotent.

IMHO, This lawsuit was not the way to go.

While it made some sense, it was not likely to succeed.

I am still optimistic that Trump can prevail.

I guess no one has standing in Federal elections and everyone can cheat like hell.

Time for a new Court. Hang the 7 dissenters.

The Supreme Court of the United States beclowned its institution by dismissing the case based upon “standing” in ignoring its own precedent in Massachussets v. the Environmental Protection Agency in which the Bay State was recognized as having quasi-standing to bring a similar suit against neighbor states over carbon dioxide emissions.

The Judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by Citizens of another State, or by Citizens or Subjects of any Foreign State.

Chief Justice John Marshall set the principle of judicial review of congressional laws

This is to perpetuate the myth that this was a creation by Marshall. It was already set forth in the plain language of the US Constitution Article III, quite intentionally and deliberately if you read the Federalist Papers.

If one wants to posit that one is bound by the State one lives in when some cases involve US citizens and some cases affect ALL citizens, then the 11th would be right - if citizens have no standing when a few States disenfranchise the whole Nation, then we are not a nation but a bunch of tribes.

Agree. There is still this little thing about a report on the security and integrity of the election that is due from DNI Radcliffe by next Friday.

I’m betting that it turns everything we’ve seen thus far on its ear.

The way I understand it is the state legislatures have the legal right of way over the supreme court in this matter. Rudy, Powell and Wood have been hammering this home. The problem is the state legislatures are spectacularly corrupt and also suck.
The legislatures punt this to SC and SC punts it right back.

The President has instructed the Intelligence and Law Enforcement Communities to ensure the 2020 elections are the safest and most secure in our nation’s history.

We take that mandate and responsibility seriously. There is nothing more sacred in our republic than the fundamental, democratic principle of one-person, one vote.

It is our duty to ensure the sanctity of U.S. elections. That includes ensuring the security of voting systems. The Intelligence Community’s role is to identify threats and assess the intentions, capabilities, and actions of foreign adversaries.

Our duty also includes empowering the American people to understand information – or perhaps more accurately, disinformation – that they are seeing, particularly on the Internet, and make informed decisions for themselves.

With that in mind, we would like to alert the public that we have identified that two foreign actors – Iran and Russia – have taken specific actions to influence public opinion relating to our elections.

First, we have confirmed that some voter registration information has been obtained by Iran, and separately, by Russia. This data can be used by foreign actors to attempt to communicate false information to registered voters that they hope will cause confusion, sow chaos, and undermine your confidence in American democracy.

To that end, we have already seen Iran sending “spoofed” emails designed to intimidate voters, incite social unrest, and damage President Trump. You may have seen some reporting on this in the last 24 hours, or you may have been one of the recipients.

Additionally, Iran is distributing other content, to include a video that implies that individuals could cast fraudulent ballots, even from overseas. This video – and any claims about such allegedly fraudulent ballots – are not true.

These actions are desperate attempts by desperate adversaries. Even if the adversaries pursue further attempts to intimidate or attempt to undermine voter confidence, know that our election systems are resilient, and you can be confident your votes are secure.

Although we have not seen the same actions from Russia, we are aware that they have obtained some voter information, just as they did in 2016.

Rest assured that we prepared for the possibility of actions by those hostile to democracy. The great women and men of the Intelligence Community caught this activity immediately, and our colleagues at FBI and DHS acted swiftly in response to the threat.

We are standing before you now to give you the confidence that we are on top of this and providing you with the most powerful weapon we have to combat these efforts: the truth. Information.

We ask every American to do their part to defend against those who wish us harm. The way you do that is quite simple: Do not allow these efforts to have their intended effect. If you receive an intimidating or manipulative email in your inbox, don’t be alarmed, and don’t spread it.

This is not a partisan issue.

I had conversations today with members of Congress from both sides of the aisle and there is complete unanimity in the U.S. government in our resolve to combat the enemies of freedom.

The President has instructed me to keep the public informed, as appropriate. You have my commitment that I will continue to do exactly that, with transparency and with candor.

We will not tolerate foreign interference in our elections and will continue to work with our many partners to disrupt, and impose cost and consequences on any adversary that attempts to interfere in our democratic processes. The efforts the President empowered us to put toward election security these last four years are working. I will now turn it over to my colleagues to address the activities.

Elections have consequences. Anyone who voted for those Democrat governors, who have ignored the US Constitution, is to blame. I’m sure that Wolf got a significant number of Republican votes in his last election. If you voted for any of the Democrat governors, or stayed home, look in the mirror.

All goes back to the theory that some place, someone has something on Roberts. Been that way for a long time...no end in sight. SAD.
