is their complacency in the fraud.
Supremacy Clause does not apply.
The Constitution declares that a State may appoint Electors in what manner the State legislature may direct.
The Pennsylvania Assembly has directed through law and easily two centuries of practice that the manner is by popular election with the slate of Electors forwarded to Congress by the necessary date.
The election occurred. The process of certification and forwarding of Electors is occurring.
The Assembly has already acted in accordance to the Constitution on Presidential elections.
The question was on many mind as to whether they would choose to direct a different slate of Electors by direct appointment, which would be in their right. Competing slates have been submitted before for Congress to sort.
By the Constitution of the Commonwealth of Pennsylvania, their terms of office expired. They can not pass a resolution. Anything they may pass would and should be immediately challenged as contrary to their State Constitution.
The General Assembly can request a special session. Otherwise, the current batch are out of a job and the new batch have to wait until January.
“Members of the General Assembly shall be chosen at the general election every second year. Their term of service shall begin on the first day of December next after their election. Whenever a vacancy shall occur in either House, the presiding officer thereof shall issue a writ of election to fill such vacancy for the remainder of the term.
§ 3. Terms of members.
Senators shall be elected for the term of four years and Representatives for the term of two years.
§ 4. Sessions.
The General Assembly shall be a continuing body during the term for which its Representatives are elected. It shall meet at 12 o’clock noon on the first Tuesday of January each year. Special sessions shall be called by the Governor on petition of a majority of the members elected to each House or may be called by the Governor whenever in his opinion the public interest requires.”
