The final step is that the electors must meet in their respective state capitals on December 14th and complete the Certificates of Vote. The state legislature may be able to stop that from happening as a last resort with the wrong people, but it doesn’t prevent the governor from sending in a differt slate of electors to Congress somehow. Then it gets interesting.

Those would be the electors confirmed yesterday?

The state legislature may be able to stop that from happening as a last resort with the wrong people, but it doesn’t prevent the governor from sending in a differt slate of electors to Congress somehow.

The governor doesn't have the power to do that. Under current law the legislature doesn't have the power to do that either. If they go ahead and appoint a competing slate without any sort of judicial decision invalidating the election then I don't see that second slate being recognized.

Then it gets interesting.

It could, but I highly doubt it will.

NO. According to 3 U.S. Code § 5, Determination of controversy as to appointment of electors, it's the electors determined six days before the time fixed for the meeting of the electors, such determination made pursuant to such law so existing on said day, and made at least six days prior to said time of meeting of the electors, shall be conclusive, and shall govern in the counting of the electoral votes as provided in the Constitution, and as hereinafter regulated, so far as the ascertainment of the electors appointed by such State is concerned.

This is the so-called "safe harbor" provision. So, if the state legislature isn't satisfied that the election was legitimate, or if a judicial injunction prevents the electors being appointed in time, it can appoint its own slate as long as that is done at least six days before the day to vote, December 8th presumably. If done after that its problematic, but could be addressed by the joint session of Congress that counts the votes.

However, both houses of Congress must agree on which electors to recognize. If they don't then it's the slate certified by the state's governor: But if the two Houses shall disagree in respect of the counting of such votes, then, and in that case, the votes of the electors whose appointment shall have been certified by the executive of the State, under the seal thereof, shall be counted. 3 U.S. Code § 15 (Counting electoral votes in Congress)

So, if the state legisture selects the Trump slate, BUT the governor certifies the Biden slate, Congress could be required to recognized the governor's choice if the houses split on which slate to recognize. So, once the governor certifies a slate, it would take a lof of judicial power to force the governor to reverse his/her certification. If the governor did something illegal in the election, he might prefer to sit in jail in contempt until Inauguration Day and then get a pardon after that, than to have an administration that will prosecute him seeking hard time.

2020 has not been a normal year in any way.

A PREMATURE concession doesn’t mean a thing if it turns out the data he had been told triggered that concession.

IF the data was fraudulent, then back to square one.

Thanks! Perhaps the same in Michigan.....but they’ve already certified? There’s so much going on....did someone file a lawsuit in Michigan? I’m pretty sure they did in Wisconsin...I want to see John James in the Congress
