My concern is that this may be hard to put together. Here in NJ specifically (I don’t know how this worked in other states) paper ballots were put into envelopes, and the envelopes themselves had the voter’s name printed on them - along with a line for the signature. Once that envelope is opened, the unsigned ballot with no name on it is counted - so I don’t see how to connect unnamed, “valid” (in terms of any watermark) ballots can be assigned to specific voters.
In other words, if my 100% legit ballot is mixed with some found in the mail and voted illegally, once the envelope isn’t paired with the actual ballot anymore the audit trail is severed. Who is to say which ballots were cast by real voters?
Depending on State law, envelopes (Outside) are registered and kept for a certain time period. If an audit uncovers a large percentage of spoiled ballots/law breaking i.e. preventing poll watchers from the count... a judge could technically rule in favor of the party harmed (I think this happened in a Pennsylvania State Senate election back in 1994). The kicker I believe was that the ruling came from a FEDERAL judge as well.
You’re right about the impossibility of separating good from bad ballots once they’re commingled for counting. Therefore, recounts are not useful.
The answer is to prove conclusively that the Dems violated state laws in place to ensure election integrity. Once that’s proven, a court can order a re-vote.
And a re-vote, under federal supervision, is also the best way to convince most voters that the final election results are valid.
