The courts have often ruled in contravention thereof
I can cite plenty of examples if you want. But if you have knowledge of the constitution and Supreme Court decision send you know what Im talking about
An Election which is smothered in fraud is a violation of equal protection and due process
So you decide whats more important. A fixed date or fundamental fairness
Now that's an interesting argument! An argument based on the 14th Amendment would be novel. The 14th has been used to justify a lot of things not envisioned by the author of the amendment -- one man/one vote and abortion for example -- but an argument for fraud vitiating a presidential election could be made using the 14th as its basis. I would be interested in seeing how the Court would view that.
