That can be a tricky proposition.
If rumors are true that Thomas wants to retire, then if President Trump nominates another African-American to hold the seat that Thomas held from Thurgood Marshall, then the Democrats will be attacking the legacy of "the Black seat." This will also attack a seat that doesn't change the balance of the court, it just makes it younger.
If it's one of Obama's women who leaves (Sotomayor or Kagan), then the fight is on again.
