Ballots can’t be tossed out over voter signature, Pa. Supreme Court says

HARRISBURG, Pa. — Pennsylvania’s Supreme Court ruled unanimously Friday on a key concern surrounding an avalanche of mail-in ballots in the presidential battleground state, prohibiting counties from rejecting ballots because the voter’s signature on it may not resemble their signature on their registration form.

Two Republican justices joined five Democratic justices in the decision.

The verdict was a victory for the state’s top election official, Kathy Boockvar, a Democrat who had asked the court to back her up in a legal dispute with President Donald Trump’s campaign and Republican lawmakers.

“County boards of elections are prohibited from rejecting absentee or mail-in ballots based on signature comparison conducted by county election officials or employees, or as the result of third-party challenges based on signature analysis and comparisons,” the justices wrote.

Trump and former Vice President Joe Biden are locked in a battle to win Pennsylvania’s 20 electoral votes.

I voted early the other day. It was merely filling out an absentee ballot at a polling place.

As I turned it in, I asked the old guy if he had to check my signature. He told me if I had gotten through to him (He was the 3rd poll worker to verify me), as long as it was signed we were fine.

The mail in ones were checked. He did not want that tedious job.

At least someone had checked. I felt it was safe and well done.

In PA the mail ballots do get counted on Election Day.

Basically they are the old Absentee Ballots. Last year they changed the law so that you could request one for any reason. You did not have to be in the hospital or working outside the country or anything.

They get delivered to your local polling place and counted along with the machine totals when they close for the night.

Actually PA’s system in that regard is better than most.

She will be confirmed Monday Oct 26 leaving 8 days before election day.

It should be enough time unless Roberts decides there’s not enough time.

However, a SCOTUS panel can stay the lower court ruliog pending a SCOTUS hearing.

Question: Can ACB stay the lower court ruling herself? Or any single Justice? Must a stay be issued by a panel of say at least 3 Justices?

Historically SCOTUS has taken such a case if at least a couple of justices feel strongly about it.

There will be five who feel strongly about it.

Problem I have is did the voter VBM and IPEV or do they just count them without checking for already voted?

Can a panel of say 1 to 3 SCOTUS Justices stay the lower court ruling?

Just so everyone knows, a ‘court stay’ means the lower court ruling is suspended pending a review. In this case, a SCOTUS panel could stay the lower court ruling until they have time to convene and hold a hearing.

Ii imagine a full court could stay the ruling before a hearing is held just by the clerks acting and issuing a signed order of their Justice. All that would be needed is for enough Justices to agree to hear the case.

the signature of when they were alive doesn’t match the signature of when they’re dead.

It won't match as you get older either.

In MA mail in ballots are opened and checked in AFTER the polls close. If you walked in and voted your “mail in” gets tossed.

Early votes are opened and processed during the Election Day at the polls.

We’ve been doing early voting for a couple of cycles. I love it.

“In her court filing, Boockvar had said that any such rejections pose “a grave risk of disenfranchisement on an arbitrary and wholly subjective basis,” and without any opportunity for a voter to verify their signature before their ballot is disqualified.”

This judge is out of line as all these rhetorics are. He would not lift a finger to make sure an old lady can cross the street absolutely safely to come in person to vote on voting day.

Considering which party will be counting the ballots, probably not a bad thing..

Very good point. Sometimes I get emotional and do not read further into an issue. I believe the GOP still has recourse. Let the left get smug and arrogant and we can beat them at their game.

Guess they need to revisit that rule because of all the dead voters being disenfranchised because the signature of when they were alive doesn’t match the signature of when they’re dead.

Well, I've heard tell that your signature does change quite a bit after you've died./s

This came up a few years back when I was working as an election computer judge in Colorado. For example if I usually sign my name A S Johnson but on my ballot I sign it Albert S Johnston will it be thrown out? Turns out, at least in my county, they have multiple signatures on file. I think I have 5 in the system. Ofc the handwriting needs to look similar too.
