The last decades?

More than a century, actually. Even the early so-called “progressives” in the 19th century were opposed to the Constitution, essentially wanting something more French Republic. Which, btw, not only failed but was rooted in a form of law (administrative law) that has in one way or another spawned much of the horrors in the modern world.

More recently, just because FDR era high handed lawlessness has been how things operate for years now does not make them lawful. That would be governance by what government has gotten away with (which pretty much sums up how the federal operates) Even Scalia, as good as he otherwise was, recognized that the modern Court (post FDR era) would have to be rejected were the ideals on which our Constitution was constructed were ever honored.

Wow. I did not know that. I don't recall that being in any of my civics classes (back in the 60s), because that explanation makes a LOT more sense.
