It can be appealed, but it will probably get a 4/4 tie because of Roberts. The ruling will stand. Still, it should be appealed. The election is almost two weeks away, and there is no good reason for most people to wait until the last day to mail the ballot.
Could they time the appeal so that it gets to the Supreme Court AFTER our new Justice is seated?
