California Republicans push back in ballot drop box dispute

LOS ANGELES (Reuters) - California Republican Party leaders, egged on by President Donald Trump, vowed on Wednesday to keep collecting ballots that voters deliver to party-furnished drop boxes in churches, gun shops and campaign offices, a practice they defended as perfectly legal.

Republicans were responding to a cease-and-desist order on Tuesday from California’s top elections official, Secretary of State Alex Padilla, demanding removal of “unauthorized and non-official” vote-by-mail ballot boxes set up by the party in at least three counties.

Padilla and state Attorney General Xavier Becerra, both Democrats, said they were giving party officials until Thursday to comply with terms of the order or face legal action, including possible prosecution.

Partisan fights over mail ballots and drop-box collections have become a defining issue in the 2020 U.S. presidential race, as the popularity of such voting methods surges this year due to the coronavirus pandemic and concerns over U.S. Postal Service delays.

Trump and his political allies have warned, without citing evidence, that voting by mail and drop boxes are rife with fraud, while Democrats have accused Republicans of using such unfounded claims to suppress the vote.

The latest clash over drop boxes in California, a Democratic stronghold, appeared to turn the usual partisan dynamic on its head.

If we had a US Attorney that could actually read the Law and the COnstitution, he would have ARRESTED AND CHARGED Padilla abd Becerra for Felony Extortion for their threatening Criminal Action on activities that are Clearly LEGAL under the Democrat Law.

The ballot drop boxes are a great idea and allow the GOP to control the security of the Republican voters’ ballots to ensure they are for Trump.

Thanks to Jerry Brown, ballot harvesting is legal in CA.. I don’t think when Brown signed ballot harvesting into law, he made the distinction that it was only legal for democrats.

ballot harvesting is legal in calif. republicans are just fighting back is all. that is why Padilla and Becerra are in a pissing contest their ox is being gored

Scott Adams said this: if you want a process improvement, ask a Republican.

So in CA, vote harvesters are legally allowed to “assist” people with their ballots, and go door to door doing so and collecting them and taking them to the mailbox for them.

So CA Republicans improved the process: just set out handy boxes to collect them in places like churches and gun shops, and then no one needs to go door to door to harvest votes.

CA Dems will get smart soon and set up their own boxes in welfare lines, colleges, etc.

AFAIK, the Democrats in the California legislature really screwed up with a law on this. Either there is no enforcement mechanism for this, or only the various county Clerks who run and oversee elections do, and they haven't because no one told them they should issue regulations on the subject prohibiting anyone but them from setting up drop boxes for mail-in ballots. And at this point the County Clerks have far too much to just getting ready for the election in three weeks, plus no budget for issuing regulations or trying to enforce them. Plus it appears, from the complete lack of enforcement mechanisms in the law, that the most they can do, even if they wanted to (and they don't at this late date) is sue each violator separately for an injunction prohibiting them from setting up drop boxes.

So the California Attorney General and Secretary of State are only making threats that they lack legal standing (legal word of art) to follow up on, not that there are any penalties they can seek, or even declaratory/injunctive relief. The County Clerks might be able to do so, but first they each must issue their own regulations and there might be mandatory waiting periods on those for public comment.

Right now its' just a big case of "ooo WHANH!" by California Democrats.
