I think they save 1st Degree murder for self-defense cases like Kyle Rittenhouse. Illinois now says they won't charge Rittenhouse at all.

Illinois now says they won't charge Rittenhouse at all.The only charge within Illinois jurisdiction was the possible possession of the AR-15 by a minor. Kyle's weapon never left Wisconsin where the homocide charges remain in place. Ergo no Illinois case against him.

In Illinois it would have only been some firearm’s charge. But he bought and stored the firearm in Wisconsin so Illinois has no say in the matter. He worked in Wisconsin and a lot of his friends lived there.
