Didn’t the SCOTUS already decide that the Court cannot be expanded? IIRC, FDR tried it and got shot down.
FDR’s plan failed when members of his own party chose not to move the legislation through Congress.
You do raise an interesting possibility, however. What would happen if the Supreme Court moved to protect itself and declared such an expansion scheme unconstitutional?
