I’m no expert on Senate protocol. But couldn’t McConnell call the Senate into session and ram it through?
Several members of the Senate Judiciary Committee are in the middle of trying to win reelection. In particular, the chairman of the committee, Lindsey Graham is facing a tough fight. Add to that there are probably at least 4 R Senators that will block Mitch. Collins, Romney, Murkowski, Sasse, Lee, and maybe a couple more. It’s not impossible, but the politics and the timeline before the election make it highly unlikely.
