If there is doubt about confirmation, McConnell can recess the Senate for over 3 days and the President can make a recess appointment who could serve through the end of the next Senate session. The recess appointment would not keep the Senate from working on confirmation of a permanent appointee who would replace the recess appointee upon confirmation.

Battles on many different fronts over many different issues with many having to do with Ginbergs replacement and who gets to vote and when and so on.
