Conservative Takeover of Appeals Court in Reach with Trump Reelection
Washington Free Beacon ^ | SEPTEMBER 1, 2020 | Kevin Daley

Posted on 09/01/2020 2:38:46 PM PDT by BeauBo

Near-total control of the federal appeals courts is within reach for legal conservatives if President Donald Trump is reelected, administration allies believe.

While the pace of Trump's judicial appointments has been steady, about two-thirds of his circuit court nominees have replaced Republican-appointed judges, University of Richmond law professor Carl Tobias told the Washington Free Beacon. A second Trump term would offer Republicans a chance to replace many judges nominated by Democrats as well, elevating Trump's judicial record from productive to transformational. The prospect of further appointments to the Supreme Court is also realistic, a chilling notion for Democrats that prompted the party to endorse "structural reform" of the judiciary during the DNC.

Research provided to the Free Beacon by the Article III Project (A3P) shows that 59 circuit court judges were eligible for "senior status," a form of quasi-retirement, at the start of 2020—about 60 percent of them Democratic appointees. It's a figure that makes Trump's supporters bullish about the future.

"In President Trump's second term, Republicans could take control of all 13 of the critically important U.S. Courts of Appeals, the last stop for 99 percent of all federal appeals," A3P president Mike Davis told the Free Beacon.

We should break up the Ninth Circuit and create a new circuit out west.

“We should break up the Ninth Circuit and create a new circuit out west.”

YES.

Get Montana and Idaho out of the ‘fruits and nuts’ court.

That alone should shut up the never trumpers. Of course it won’t. I can’t believe those conservatives especially who hate trump want to destroy the country. Since when has it been a requirement to like the president? I’ve not like the supermajority of them and that includes many I voted for.

Besides illegal immigration control, this is the main reason I voted for Pres. Trump. He and Schummer are reshaping the courts back to their Constitutional duties. Also, I didn't even imagine such a positive impact on the economy. I thought it would improve, but it started while he was still President Elect. That fact alone says everything about this President and his influence over industry.

The dem/soc/coms can try to give credit to Obambi and they've tried but to no avail. I never hear the meme mentioned anymore. If there are debates, we all know Biden will try to claim such a historical economy on his tenure as VP. If he doesn't go there, he will try to blame the failing economy on Trump rather than the China pandemic.

It's no wonder so many dem/soc/coms are trying to avoid a direct debate (including Pelosi). Trump will win any debate with SniffyBiden and will shut him down even on Slo-Joe's best day.

Are there enough “conservative” judges coming up through the ranks, i.e. are there young ones, or are there every few below a certain age?

So far Trump has only placed 53 judges on the Appeals Courts. Obama places 55. Trump has almost but not quite countered Obama so far. We won’t make actual progress until his 2nd term. It’s all been damage control so far.

But how many of them are in the first five to ten years out of law school?

In President Trump’s second term, traitorous judges need to be indicted, tried, and convicted.

You probably want someone more like 15 years out of law school....40-43 or so. There are plenty of that age. The Federalist Society has members who are law students, members who are young law clerks, members who are federal district court judges, state court judges, etc.

California, Nevada, Hawaii in the new circuit. The rest remain in the Ninth.

This creates a certain number of vacancies on each circuit, which President trump then fills.

Trump is close to having control over the 9th, if he doesn’t have it already.

He needs to get the DC court.

So how many people here STILL think “There’s no difference between the parties” - and therefore will ‘send a message’ to the GOP and SIT OUT the election, you know to ‘teach McConnell a lesson’?

Probably some, and if you’re one of them, you look like spoiled crybaby (and no, I don’t give a crap if you fought in Vietnam, you’re still a traitor if think that about the Republicans).

I want judges who interpret the Second Amendment as a mandate, not a right.

Firm up our control, and create another circuit we can also control.
