Remember, I was wrong on the whole question of an en banc hearing, I thought that the Court would deny it. So much for my credibility.

The fact that you admit you were wrong just cements your credibility. If I had a nickel for every time I was wrong on here, I'd probably have a few bucks myself. :-)

IMO if this thing isn’t resolved by Election Day...in Flynn’s favor...the President will pardon him soon after the Election.

I would agree, but especially if Trump loses. If he wins he may let it play out to exonerate Flynn. A pardon will send the left into a tizzie saying “see, Trump had to pardon Flynn because there was guilt in the Russia investigation”.

The members of the COA already damn well know what the criteria is. It is clearly spelled out in the Rules for Judicial Conduct. They aren’t that stupid.

The original three-judge panel should have ordered that Sullivan be removed from the case. That would have prevented the subsequent disaster and embarrassment.

Sullivan interjected himself into a case between two parties. That is blatant bias against both parties. Even worse, he invited someone who has a great deal of animosity against Flynn, Powell, and Trump to participate on Sullivan’s behalf to salvage a prosecution that never should have been brought in the first place because Flynn is completely and objectively innocent.

I could be that the liberals on the D.C. Circuit are having second thoughts about granting a hearing. It may have been an emotional decision at first, but the reality that will be exposed as the corrupt fools they are must be sinking in.

Oral arguments are going to give Powell the opportunity to rip Sullivan a new asshole; in a marginally polite way.

Sullivan’s career as a Federal Judge is over.

Yes,if Trump were to win Flynn might ask the President not to issue a pardon so that he can fight this out in the courts.But if the President loses he’d be wise to hope for...or even ask for...a pardon because there’s no *absolute* guarantee that the courts will make the right decision at the end of the day.

My speculation is that the Left leaning judges are looking for a technicality, to do what most helps the Democrats, despite the obvious injustice of it.

Sullivan’s career as a Federal Judge is over.

Unless he's impeached by the House and convicted by the Senate (like Alcee Hastings was) it's certainly *not* over.

He's beyond shame so he certainly ain't gonna resign.

Appointment to the Federal bench is for life...except in impeachment.

Once Sullivan made himself a party to the case, how could he remain as a judge on the case? Is that the issue?

I agree with your approach but this is a liberal panel and it concerns me they are asking a question which I don’t believe was raised by the defense. I doubt they are going further than what the defense charged. Therefore, I think they want to put it to the defense that they can’t prove the judge is biased.

My speculation on the court asking about the rules on recusal: first a fact, the panel didn’t cover that ground even though Flynn asked to have Sullivan recused. Court just blew off that part of the request for relief. My speculation is that Rao told her peers that she intends to pursue this legal issue.

At least that way the court will have addressed all the relief asked for in the first place. I don’t think it changes the outcome.

You got it, exactly. Whether Sullivan can be impartial, let alone present the appearance of impartiality, is a rather obvious issue at this point.

It already has that.

Flynn May 19, 2020 Petition for Mandamus

Powell asked the Circuit Court to order the district court to assign another judge. Part IV, starting on page 31 goes into detail on Sullivan's action.

The DC Circuit panel denied the request to order reassignment. DC Circuit June 24 Opinion and Order, see starting at the bottom of page 11. Sullivan's conduct did not rise to a level that justifies reassignment.

It'll be a shocker if the DC Circuit decided to walk that back. The DC Circuit found that Sullivan's conduct during the trial was not such that it shows inability to render a fair judgment.
