Again? How many times has this been decided?

It is really just different motions, on the same underlying case.

Last July, the Supreme Court ruled that the use of DoD Counter-Narcotics funds could continue, until the issue was finally settled by the Courts - all appeals exhausted (i.e. makes its way up to the Supreme Court itself).

Now they have just refused a request to withdraw that ruling.

Last year, it was District Court Judge Haywood Gillam, ordering the President to cease and desist - the Ninth Circuit just decided to let that stand, until they got around to deciding for themselves on the appeal.

This year, the Ninth Circuit got around to agreeing with Judge Gillam, so the case will go to the Supreme Court next term (if they accept it).
