I thought the state AG was going to heve it dropped?
This is one of those rare cases where the prosecution clearly amounts to a crime itself.
Isn’t this illegal?
In most states tampering with evidence is a crime.
Good. Altered evidence seems like grounds for a mistrial if they get convicted.
Chain of custody is broken.
“...police have to verify that the guns actually posed a threat...”
There’s the police on the bad guys side again. Some blue lives matter.
Doctoring the evidence.
St. Louis is such a wonderful city.
“...Patricia McCloskeys Gun Didnt Work...”
What an idiot..having an non-operable firearm.
It should be grounds for dismissing the charges BEFORE it ever gets to trial! And bring the DA, assistant Circuit Atty, and the head of the lab up on tampering with evidence charges NOW.
Probably not if the the trip to the crime lab was recorded and the name of the custodian while at the lab. The lab does that stuff every day. The real question is what will the the response be under oath when the defense asks about this incident.
Some might call it evidence tampering.
They FABRICATED EVIDENCE in a Conspiracy against her rights.
Title 18, U.S.C., Section 241 - Conspiracy Against Rights
This statute makes it unlawful for two or more persons to conspire to injure, oppress, threaten, or intimidate any person of any state, territory or district in the free exercise or enjoyment of any right or privilege secured to him/her by the Constitution or the laws of the United States, (or because of his/her having exercised the same).
It further makes it unlawful for two or more persons to go in disguise on the highway or on the premises of another with the intent to prevent or hinder his/her free exercise or enjoyment of any rights so secured.
Punishment varies from a fine or imprisonment of up to ten years, or both; and if death results, or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title or imprisoned for any term of years, or for life, or may be sentenced to death.
I suspect that this is not nearly as rare as you would hope it is.
When there’s nobody in charge of the people in charge you get tyranny... Every time.
We are all gonna’ get railroaded be this govt if we can’t get rid of filthy democrats like these.
It is tampering with evidence. Being ordered to disassemble the weapon, then reassemble it so it works changes the condition that the item was in when it was first confiscated. It’s no different than taking a bloody shirt, and putting it through the laundry before presenting it as evidence.
Now we know why the lawyer had the pistol.
