I don’t get it.

How did cops find the gun?
What evidence did they have that he fired a gun?
How do they know that he fired the gun at the perp and not in the air?

Did he actually shoot him? Shooting at someone who did what the BG did is a warning shot, as in “AND DON’T COME BACK!”, IMHO.
