The road the “protesters” were on is a private road inside the gated private community where they lived... I'm guessing the prosecutor would distinguish between a collectively owned road/easement and their actual property in the context of the existence of a threat. Not necessarily my opinion, what matters at this point is the prosecutors opinion. And finally the jury
