No Judges Confirmed This Week (Senate on two week recess)

This will be a weekly post.

Count remains at 200 judges confirmed.

2 Trade Court judges

143 District Court judges

53 Circuit Court judges

2 Supreme Court justices

There are currently 44 District nominees pending, 11 on the floor.

Since the Senate is in recess, can Trump finally make some recess appointments?

It’s technically a break.

Recess appointments, especially for judges, are a bad idea. Their commissions would expire. Better to get permanent appointments.

When they return, Senators will be under some pressure to pass another coronavirus relief bill since some unemployment benefits expire at the end of the month. However, the cloture clock for appointments continues to run while the Senate debates other matters. So, while the press focuses on COVID, McConnell has the opportunity to slide a few more judges through unnoticed.

Cloture for District judges (all that remain) is only two hours each.

The President should shut off the electricity to both bodies of Congress until they pass a budget he will sign. Let ‘em swelter in the August heat during daylight hours.

It will build character.

I’m all for getting as many strict constructionist district court judges on the federal bench too....but the Circuit Court and Supreme Court are far far more important. Those have all been filled which is great news.

Weren’t all federal judge vacancies filled? I would assume now the rate of appointments be very slow based on attrition (old judges dying or retiring)

All Circuit Court spots were filled. Those are highly important since most cases never make it to the Supreme Court. District Courts are far less important but still, it is good to put as many strict constructionists on the federal district courts as possible too. That’s also the talent pool to draw from for future Circuit Court positions. There are 40 district court openings left to fill. It looks like the Turtle will manage to fill almost all if not all of those by the end of this Congress.
