Do you really think putting the toothpaste back in the tube is possible? Not being sarcastic, just doubting that its even possible given the profound cultural and demographic changes in this country. We are not the same country we used to be. As we see time and again our laws are now selectively enforced. We have a tiered legal system and that is firmly established.
Just to go back to the Indian law I cited. Most, if not all, Indian treaties in the US are incomprehensible, even irrational, and have long needed to be renegotiated. Right now, many reservations have near primitive living standards for the simple reason that there is no federal business law that applies within.
Again, in Oklahoma, many oil wells are leased, with lease payments going into Indian “trust funds”, with little or no accounting, which means billions of dollars has been grafted off by corrupt BIA officials. Finally when the courts forced the BIA to surrender the documents about it, the BIA just shredded them instead to hide the evidence. All the courts did was to cite the BIA heads for contempt, with a fine of a couple of hundred thousand dollars in fine.
So, steal a million and get fined $10 and an oral reprimand.
Mind you, some presidents in past have wanted to reform the BIA, but they quickly gave up and passed it on to the next guy. No doubt President Trump would want to do something about it, but he could not get any momentum unless the SCOTUS went in and stimulated everyone else first.
Like this bit with OK. The SCOTUS is more than away that their decision is intolerable, but it will finally force congress and the president to act.
