He cant appeal.
He will take the entire 20 days and then respond to the appeals court that he will not dismiss the case and will instead request some additional action from them ... perhaps a hearing before the full court instead of just three judges. The clock resets and yet another month of Flynn’s life is thrown away as Sullivan drags this out to max extent possible. It’s malicious prosecution by a judge, of all things.
“He (Judge Sullivan) can’t appeal.”
Good news - then the Flynn Case gets dismissed in the next week.
But Wilks can.
