Couple who pulled guns on Black mother and daughters charged with felony assault

A white couple from Clarkston, Michigan, was arrested and charged with a felony after a video showed the woman pointing a gun at a Black mother and her two daughters.

The fact that people are aware that black thugs can invent a racial incident and go into berserk attack mode in a flash.

Ditto the Flint Michigan Macy’s worker.

It becomes the basis for a reasonable fear for your life (or serious injury.)

Agree - however, in a ‘mob scene’ (especially IF you are in your vehicle) and you are surrounded, I do believe ‘flashing’ it will move the mob to the point where you can depart the scene as they ‘step back’ to evaluate the situation and before they realize you can’t shoot them all BUT it does takes ‘guts’ to surge forward if you realize you may be taken out so you may have time to leave.

A gun is not a magic wand. For it to have ANY deterrent effect, the other person MUST BELIEVE that you will fire. The black woman did not believe. White couple loses.

That's why you need more tools in your self-defense tool box than just a gun. The black woman didn't believe the gun, but probably would believe pepper spray.

But that section of the law only identifies force other than deadly force.

Correct, but an attorney could argue that deadly force was not used as the gun was not fired. The direct reading of the statute would apply in that case.

Saw that from a link on Parler. There’s been double standards on this type of attack for a long time now. It’s just gotten worse over the past month because the media is raging the fires. Democrats holding AG and DA positions are showing just how racist they are by letting looters and rioters go, but prosecuting whites who are within their legal rights to defend themselves. Democrats have made it open season on all police officers, and whites defending themselves. I hope their hypocrisy destroys them.

I realize not a ‘magic wand’ but you may be able to cause enough ‘confusion’ with them that will allow you to get out of ‘Dodge’

It is a very small window but better than drawing and opening fire immediately which - especially in todays climate - will probably get you in MORE trouble...

Earlier I had ‘half joked’ that it would be cheaper to GIVE everyone a body cam than what the different towns and cities pay off for ‘edited film’ etc.
At least Police should be wearing AND recording with some sort of ‘anti tampering’ system AND available for review by ‘interested parties’ Would save a lot of time.

I remember a few years ago LEO was ‘glad’ for dash cams when it came to DUI for once the guy sobered up and they showed him himself the night before, a lot of cases got cleared up quickly.

Pointing a gun at someone can be called 'assault'; the law varies. The picture of the St Louis couple defending their home from a mob show the woman with her finger on the trigger...a thing someone with a little training would know you don't do. They didn’t “use” deadly force. Showing a gun may be brandishing, or assault, depending on state law, but it is not “using deadly force” until you pull the trigger. Jesus christ, the dumbassery on these threads is amazing.

Simple solution:

Michigan is a strong home rule state that allows voters to recall any elected official - for any reason - by signing a recall petition. With this simple fact in mind, this incident will require that conservatives circulate a petition to recall the Nazi Oakland County prosecutor.

This is a very fast process that will remove the Oakland County prosecutor and make her stand for election.

If a gun or other weapon is drawn and displayed in such a manner as to intimidate, threaten or otherwise impress upon another person that deadly force is imminent, then that is brandishing. She definitely did that.

Like I said in my other post, doubted, and still don’t understand, why a felony charge was applied and that will be lowered. THE MICHIGAN PENAL CODE Act 328 of 1931

750.234e Brandishing firearm in public; applicability; violation as misdemeanor; penalty:

MCL 780.971 to 780.974.

(3) A person who violates this section is guilty of a misdemeanor punishable by imprisonment for not more than 90 days, or a fine of not more than $100.00, or both.

She did brandish by trying to intimidate. And she used the gun in a wrong situation. But the law places it as a misdemeanor and non-felony charges are unwarranted.

Understood but you don’t mess with your self defense guns, especially off your own property. They are for deadly force situations, not every altercation.
