The question for Chief Justice Roberts is this: In the Brown v. The Board of Education case would he have voted to maintain Plessy v. Ferguson on the basis of stare decisis?

Brown v. Board did not overturn Plessy v. Ferguson. Earl Warren didn't have the votes to do that.

The ruling was confined to K-12 schools and it was based on "new insights from psychological research".
