Either the prosecutor or the defense appeals, why is this judge allowed to?
the judge is saying that flynn is disrespecting the court because he plead guilty when he was not, so the guilty plea should override the fact that there is no prosecution left.

I suspect that such an appeal, which would be via a request for an en banc review of the decision, is very rare. But apparently Sullivan could make that request as could any judge on the Circuit Court.
Who knows what Idiot Sullivan will do? I dont. But there must be some sort of time limit on how long he has to make an en banc request.
If anyone knows if there is or is not a time limit they should let us all know.

Good question. The judge is neither of the litigants in the case, not the prosecutor nor the defendant; so from where comes Sullivan’s “right to appeal”?
You have to keep in mind what the issue is. The issue isn't dismissal. The issue was the judge's conduct. He is a party to that.
