To be appealed, no doubt.

An appeal can only be brought by a party to the case. Here, both parties agree that it should be dismissed. There is no party that will appeal.

No, it's over. Judge Sullivan must follow the decision of the Appeals Court and dismiss the case. He doesn't have any discretion.
