Yes.

Was the taser “empty” and could not be used to incapacitate the police officer?

Yes. According to the DA the shot Brooks fired while fleeing was the second dart and the Taser was useless. Rolfe shot him after that.

How can he shoot an empty taser?

Your answers contradict each other.

Your second answer is irrational, but does provide the info.

The taser the suspect Brooks took control was able to be fired and had the potential to incapacitate the officer.

You indicated differently in an earlier post.

I never said he did. He fired the second dart while fleeing and after that the Taser was empty and no longer a threat. It was empty when Rolfe shot him.

Not at the point when Brooks was shot.
