IOW, up the time of incarceration to 5 plus years for resisting arrest from the 12 month average. Okay, you have a jacked up shoulder from wrestling in school. You're in the wrong place at the wrong time; 4 police tackle you to the ground, put your hands behind your back, aggravating that old injury quite a bit. You start grunting in pain and squirm - they start screaming stop resisting and proceed to kick you in the gut.
Should you get 5 years because of an old injury that came back in a vicious manner?
