But against Sullivan's attorney stating that no prosecutor signed the motion to dismiss, we now have the heaviest legal hitter in the US government weighing in. For those who don't know, the Solicitor General is the person who argues for the US before the Supreme Court.

Nor, under the circumstances of this case, may the district court assume the role of prosecutor and initiate criminal charges of its own. Instead of inviting further proceedings, the court should have granted the governments motion to dismiss.
There it is, right out front. Cut and dry.

Sydney has 7 days to file a reply brief on Sullivan’s brief. Given the Solicitor general’s response I would suggest she file a very short reply to Sullivan saying that Sullivan ducked the issue, there are only two sides in this case and both have agreed to file. There is no third party and he doesn’t represent them.

There is no case currently in existence to prosecute since both sides agreed to dismiss. The judge no longer has a case to adjudicate.
