This is a tough one. These are private companies that in theory should be able to delete or ban him at will.

I believe these companies describe themselves legally as communications purveyors, and not content providers, to limit exposure from lawsuits having to do with crimes discussed described on said platforms. If they are shaping the content, that legal protection should be removed.

Trump has a lot of power to f*** them up if he chooses to use it. The Justice Department can launch an anti-trust investigation against them and give them a reaming.


Unfortunately, the DOJ anti-trust division is full of liberal Democrats. There’s no way they would support POTUS on this in the very few months before the election.

Amazing how some can’t notice conservatism hasn’t advanced since Reagan and why that is. I’ll buy you a clue: being a Democrat punching bag does not advance conservatism. Fighting fire with fire in a Trumpian way does.

YES!!!! a private company has EVERY right to deny your freedom of speech! Freedom of speech protects you from the Government, NOT from private companies.


Government is outsourcing totalitarianism. Government has no need to censor you speech if a private company does it for them.

If they are media companies such as newspapers and television and radio and magazines as private capitalist companies then they also should be open to charges of defamation of character and being sued for false reporting but they aren’t. They get to have it both ways make millions billions being a capitalist company and capitalist media yet not follow the rules at all for what they tolerate being quote printed un quote.

I don’t like this ends justifies the means mentality going on here. And my post 271 completely destroyed their entire legal argument for this kind of punishment against a publisher anyway.

Perfect exactly and well stated that is the issue these companies can’t have it both ways be a public media platform and yet not be held to any kind of minimal regulation

They need to decide if they are a platform or a publisher. The phone company is a platform. They cannot turn off your service for telling a lie to someone over the phone. The advantage is, they can't be sued for something that is illegally said on their platform. If I say I want to murder someone on their phone line, the phone company holds no liability.

A publisher has the total right to control the content on their product. That is an advantage. The downside, is they can be sued for libel for anything that goes on on their product.

Companies like Twitter and Facebook have been trying to take the advantages of being a platform or a publisher, without the downsides. They need to pick which one they are. Are they like a phone company, or are they like a newspaper?

Exactly. They can be a publisher, in which case, they’re totally open to civil liability for their content moderation.

Or they can be a platform, and only take down activity that violates the law (incitement to violence, child porn, etc.).

Since they are only hosting members’ opinions, I’m not sure how they can be liable. Is JR liable for what someone says on FR? No. In fact on my post 271 I link to a site that pretty much clears all this up.

Freedom of speech means just that. You have the freedom to speak. You can walk out your front door and spout the most bat shit crazy stuff you can think of, and the government can’t shut you up.

But that doesn’t mean you have the right to be heard. A private entity has zero obligation to support your ability to speak. I assume you’re smart enough to see that that’s a good thing.
