Arbery Family Lawyer: 'Justice by Video' Is Not Justice

The Atlanta lawyer who has joined the legal team representing the family of Ahmaud Arbery—who said he is working on litigation related to the fatal shooting, and predicts that “there’s going to be a ton of people getting sued”—certainly has experience in police shooting cases where video plays a crucial role.

In a phone interview with the Daily Report Thursday, L. Chris Stewart of Stewart Trial Attorneys would not give details of planned lawsuits, but he said he will serve as local counsel for S. Lee Merritt of Philadelphia, the civil rights attorney representing Arbery’s mother. Civil rights attorney Ben Crump of Tallahassee, Florida, is representing Arbery’s father.

Stewart said he has known both Merritt and Crump for years and was quick to say yes when Merritt asked for his help.

“This happened in my state,” said Stewart, who has traveled around the country to represent families of young, unarmed black men shot by white police officers.

Arbery was killed on Feb. 23. No arrests were made until May 7—two days after the release on social media of a video of the shooting. Gregory McMichael, 64, a former Brunswick police officer and district attorney investigator, and his son Travis McMichael, 34, were charged with murder and aggravated assault.

Crump has said the Arbery case bears a chilling similarity to the one that made him famous: He represented the family of Trayvon Martin—the teenager killed by a neighbor in Florida while walking home in 2012. The shooters in both the Martin and Arbery cases claimed justification because they were suspicious that the young men were involved in recent neighborhood burglaries.

"I guess they could sue McMichaels for the shooting, but I don’t see how the police department was responsible."

There's a text from a police officer to Mr. English, the owner of the property, who house was being trespassed on, telling him if he needed assistance in keeping an eye on his property, he can contact McMichael...the father as he was a retired police officer.

There were no police officers present during the incident between Arbery and the McMichaels.

In slowed down frame-by-frame video, it’s clear we have no visual of the moment of the initial encounter between Travis McMichael and Arbery. Arbery ran past the truck on the passenger side. Travis McMichael moved from the driver side to the front of the truck. As Arbery came to the front of the truck, the truck blocks the view of whatever takes place until Arbery and Travis McMichael are already engaged in a life and death struggle. There is no audio of any words exchanged between Arbery and the McMichaels during the encounter.

George Michael Zimmerman (born October 5, 1983) is an American who fatally shot Trayvon Martin in Sanford, Florida, on February 26, 2012.   On July 13, 2013, he was acquitted of all charges in Florida v. George Zimmerman.

And the prosecuted persecuted McMichael family will be a acquitted in the same way for the same reasons.

Arbery did nothing actionably wrong up to the point of grabbing the shotgun.
He’s no saint, but also not clearly guilty of anything relevant.
Ergo the McMichaels are likely guilty of attempting an unlawful arrest.
(Trespassing, retroactively allowed by the owner, wasn’t enough.)

In Travon’s case, he jumped & was literally beating Zimmerman to death.
Didn’t happen here.

Arbery tried to disengage for 4 minutes. McMichaels persisted. Flight having failed, fight took over.

Unlawful arrest gone wrong, someone died, felony murder.

Gonna be an ugly case, which McMichaels will lose.

Yes,the heirs would very probably win a civil suit,not that they necessarily would deserve to win.But then how much could they get from these guys? Probably not much.

But if this case were to go to trial with only the evidence that I've seen (four videos) there's no way that I,a juror,would vote guilty...not because I'm convinced they were justified in what they did but because I'm not convinced that they weren't.

And that’s what it’s all about - publicity - right down to an attorney for the mother and a different one for the father. What a coincidence. And they had to go all the way to Philadelphia for another one? Never, never give up stoking the fires!

The real girl-friend that was on the phone, Diamond Eugene, didn’t want to testify
so the prosecution substituted the false witness Jeantel.

It came to light fairly recently, perhaps you aren’t yet aware of it.

Katherine, you may want to do a little research before you spout an opinion on justification. In the Trayvon case (blessed be his name,) Mr. Zimmerman was found to have justifiably aerated Trayvon because the perp was pummeling him an smashing his head into the cement.

Sure there was. They may have been retired or off duty but cops none the less.

At least that’s what I would say. Although I wouldn’t have gotten myself into either situation. Well - unless one of them tried to break into my vehicle as I was watching them waiting for the police to arrive.

thank you, another fellow freeper gave me the link to the lawsuit, that is something, all lawyers on the prosecution side should be serving a 10 year prison sentence and lose law license for life.

Who do they think has deep pockets here? This is not a civil rights matter - the shooter(s) were not acting under color of law - they were not government employees. Sue the father and son for all they have and you get airfare to Philadelphia for 5.

The initial encounter between Travis McMichael and Arbery occurs at 1:13. At that point in the video, both men are at the front of the truck. The person filming is behind the truck. Neither Travis McMichael nor Arbery are visible for several seconds at the point when they first encountered one another. The next time we see them, they’re already engaged in a fight.

Travis McMichael has never been a police officer.
