I watched a youtube this morning that said the legislature has filed suit against Gov Whitmer.

My understanding is there is a 1945 emergency powers act that gave the governor pretty much complete power during an emergency. However there is a 1976 statue that limited the governor’s power and required a legislative estension past 28 days.

The legislature apparently voted against extending her powers, but she has maintained her orders anyway.

If that’s the case, I expect Whitmer will lose.

Can someone confirm that’s the issue?

Case was already heard on Friday by Democrat judge who will likely throw it out. It’s expected to be appealed to the Michigan Supreme Court and with that court’s 4-3 conservative Republican majority; I can only hope it’s in our favor.
