Michigan Gov. Whitmer cries ‘power grab’ after state GOP challenges her emergency powers

Facing a lawsuit by state Republicans over her use of emergency powers during the coronavirus outbreak, Michigan Gov. Gretchen Whitmer fired back Tuesday, accusing the GOP of a “power grab.”

“This is more than a political bluff for a dissatisfied coequal branch of government holding a losing hand under applicable law,” Whitmer wrote in a legal filing submitted Tuesday, according to The Detroit News. “It is a power grab cloaked in the fineries of unfounded legal reasoning.”

Oral arguments in the dispute are set to begin Friday, the News reported.

I don't understand why the feds don't put an end to the trampling of the peoples constitutional rights!?

Regardless of what or how individual state constitutions are written .. States are subject to the U.S. Constitution, same as the feds!

No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States.

This greatly expanded the civil and legal rights of all American citizens by protecting them from infringement by the states as well as by the federal government.

The third clause, "nor shall any State deprive any person of life, liberty or property, without due process of law," expanded the due process clause of the Fifth Amendment to apply to the states as well as the federal government.

Over time, the Supreme Court has interpreted this clause to guarantee a wide array of rights against infringement by the states, including those enumerated in the Bill of Rights (freedom of speech, free exercise of religion, right to bear arms, etc.) as well as the right to privacy and other fundamental rights not mentioned elsewhere in the Constitution.

In Marbury v. Madison (1803) the Supreme Court announced for the first time the principle that a court may declare an act of Congress void if it is inconsistent with the Constitution.

Even if it is a power grab, we need to do this far more often. What the corrupt thugs on the left did to President Trump needs to become the new normal any time the globalists overreach - any time they attempt to act beyond the powers enumerated in the federal or state constitutions. And this litigation should not just be limited to the actual issues.

Lawsuits and investigations on a massive scale are needed to cripple our enemies and keep them so busy defending that they have no opportunity to attack our God-given rights or to do whatever they imagine their position gives them the authority to do to us. “Resist”? It’s an unusual sword that doesn’t cut both ways.
