Alan Dershowitz says Barr did right thing in dropping Flynn case: 'There was never a crime'

The Department of Justice (DOJ) and Attorney General William Barr did "exactly the right thing" in dropping charges against former Trump administration national security adviser Gen. Michael Flynn because there was never a crime committed, Harvard Law School Professor Emeritus Alan Dershowitz asserted Friday.

Flynn was exonerated by the DOJ on Thursday afternoon. The action comes even though prosecutors for the past three years have maintained that Flynn lied to the FBI in a January 2017 interview about his conversations with the Russian ambassador and following Flynn's own guilty plea.

In a phone interview on the "Brian Kilmeade Show," Dershowitz said he feels that Barr probably cleared Flynn too late.

"In December of 2018, I wrote an op-ed piece saying there was no crime. Why? Because what he said -- what Flynn said -- was not material to the investigation for two reasons," he explained.

"Number one: the FBI already knew what the truth was," Dershowitz remarked. "They had him on tape. They had recorded him. talking to the ambassador [and] then they asked him, 'Did you talk to the ambassador?' They weren't looking for information. They were looking to spring a perjury trap."

Secondly, Dershowitz noted, newly released documents show FBI leaders including former Director James Comey and Deputy Director Andrew McCabe were looking into the Logan Act.

Laws for thee, but not for me says the FBI. It's illegal for you to lie to the FBI, but perfectly legal for the FBI and other law enforcement officers to lie to you.

The power needs to be reversed, not equalized. Anyone in government, LEO's or not, and at any level, should be convicted of a felony if it was found that they lied to you about anything. Citizens should be allowed to protect their freedoms and liberty by being able to lie to law enforcement. I wouldn't advise it, keeping your mouth shut is the best option, but it should not be illegal for citizens to lie.

Why are there no questions about the black robed terrorists that let the trial take place in an extremely partisan manner with NO justice involved at all? This is why he plead guilty! our judicial branch of the government is out of control and not accountable. Congress needs to do their job and get rid of judges like her. There are many!

I’ll feel better when the judge signs the approval.

Meanwhile,there’s still a guilty plea on the table. Before the DOJ withdrawal, all that remained was a sentencing.

I wouldn’t put it past the judge to sentence Flynn anyway and give some stupid lecture to the DOJ.

I don’t trust any of these bastards. Nothing is over until it’s over.

The FIBers lied to the FISA court. They need to be prosecuted for that as well as leaking classified material as well as various other violations of the law they committed during Obamagate.

Perjury, i.e., deliberately to make false statements to a court or in a deposition while under oath, or knowingly to sign false statements and affidavits, has been a crime for centuries.

The crime of “lying to an FBI agent” is a contrived scheme for extorting confessions and/or “cooperation”. Unlike for perjury, the required proof is subjective or imaginary: the FBI agents get to decide what was said, without any audio recording. I’m not sure how this could have come into existence as an acceptable practice. It must end now.

The Democrat House can block reform, but President Trump can issue an executive order banning use of this by the DoJ and FBI.

Trump could probably issue an EO where he declares that ALL FBI interrogations must be recorded, that the recording must be kept, that the 302 is just a summary of the recording, and that the agent is liable for perjury for falsifying a 302.
