Observed by the father & son illegally entering through the rear of a home under construction adjacent to the fathers, and exiting out of the front door
Even if that were true, it would have zero implication on what happened. The father and son had no right to what they did.
One of the problems for the people arrested, is that on the initial police report, they clearly stated they wanted to ‘stop him and ask questions’. That initial comments goes to the mindset of the situation. Either don't talk to the police, or say it was a citizens arrested because you saw the individual commit a felony. One doesn't need to ask someone questions if they witnessed them committing the crime. Also, they said they saw him prior with his hand in his pants, which they deduced he could be armed. So, they went inside their home to retrieve weapons to confront the possible armed person with.
