Maryland Gov. Hogan Faces Lawsuit Over COVID-19 Orders(over political rallies and religious gatherings ban)

RELIGIOUS LEADERS, state lawmakers and businesses filed a federal lawsuit against Gov. Larry Hogan and other Maryland officials on Saturday for violating Americans' constitutional rights during the coronavirus pandemic.

A number of governors are facing similar lawsuits, including Michigan Gov. Gretchen Whitmer, who was sued on May 4 by Rep. Paul Mitchell (R-Mich.) for her stay-at-home order, which will remain in place until at least May 28.

The lawsuit filed against Maryland's Republican governor, Health Secretary Robert Neall, Deputy Secretary of Public Health Services Frances B. Phillips and Maryland State Police Superintendent Woodrow W. Jones had been under discussion for weeks, according to WTOP News.s

Maryland Del. Neil Parrott, one of three state delegates who filed the lawsuit, said the group decided to move forward after Maryland State Police told Del. Dan Cox that he might be arrested if he attended and spoke at a political rally Saturday protesting Hogan's executive orders amid coronavirus.

Parrott told WTOP News that the police used Hogan's stay-at-home order, which bars gatherings of more than 10 people and requires residents to stay at home except for essential activities, as their reasoning for keeping Cox from the event.

"But that's really a violation of the freedom of assembly, it's a violation of allowing us to speak our minds," Parrott said.

The lawsuit also claims that state officials are depriving the religious leaders listed as plaintiffs in the case from their freedom of speech, along with their religious and assembly rights. According to the lawsuit, Maryland State Police have "threatened to impose criminal sanctions against religious gatherings of any kind, even though these churches were engaged in First Amendment protected activity, were duly operating social welfare and food bank services, and at their worship services were practicing reasonable and determinable social hygiene and distancing, and were exceeding government CDC and international WHO recommendations."

The plaintiffs also allege that the state "disparately and discriminately" allows certain businesses such as liquor stores to stay open and to be categorized as "essential," while refusing to categorize religious gatherings as essential.

First of many, many lawsuits against govs, mayors, etc. that violated constitutional and Bill of Rights provisions. This will be years working through the courts with appeals, etc.

I was at the rally Cox was threatened not to speak at.

The rally was a road rally with several stops throughout the state. At the last one, cops blocked the rally point and tried to prevent a US Congressman from speaking with citizens redressing their grievances with the government.

Then the governor lied on CNN (I guess you can call that national TV) about the number of protesters. He said a couple dozen.

Reality was closer to 250.

He said he was not going to open anything for two weeks after cases went down. He blinked and opened a little bit of stuff after five days.

Governor Hogan. Is ruling from a position of fear. President Trump is leading from a position of competence and confidence.

Hogan is supposedly republican and despised Trump.

At least he vetoed Kirwan. After O’Malley and Spendening, Hogan looks like Reagan. I dread what comes after Hogan.

And he surprisingly also vetoed an absolutely stupid gun bill that would have required FFL and background checks for all private long gun sales.

He still has some cogent thought going on in his head but the way he’s handling this virus thing is just bizarre.

I was OK with lockdown a month ago to give medical industry the time they needed to ramp up.

They’ve got more figured out now so its time to get back to business. I was in a restaurant picking up yesterday. The owner told me that they can’t do seating until Phase II starts. IIRC, that’s predicted to be sometime in September. They will be bankrupt by then, as will most restaurants, especially non-franchise ones.

I’ve seen the same. As I understand, Average fatality is age 73 or something. The median is 80.

Zero cases of kids so let’s keep them out of school.

Actual homeschool kids are going to have a massive leg up in a few years
