Yeah, upon reflection perhaps it was kind of harsh, but he most certainly had other options than to jail this woman. Moreover, as part of his sentencing he wanted her to grovel and ask for forgiveness from him (the court) along with an her personal admission that she acted out of selfishness.
That type of arrogant attitude and high-handedness from a state official is reminiscent of the old East German government. I see no reason he felt compelled to act in this manner towards this woman other than out of some personal or political malice.

The authority for the EO rests on the Texas Disaster Relief Act of 1975 which says:
"The plan may prescribe a punishment for the offense but may not prescribe a fine that exceeds $1,000 or confinement in jail for a term that exceeds 180 days."
In reality I think she was sentenced for violating the judge's cease and desist order and the judge has pretty broad discretion on punishment.
It isn't unusual for judges to offer the chance to make apologies or do community service in lieu of jail time for civil violations like this.
He did offer her the chance to apologize instead of going to jail.

Judges don't like that.
