I heard that they can not charge someone with trespass the first time. You get a warning. Then if the person comes back a second time they can be charged?

Not sure on Idaho/open public lands, but if you're on private property and asked to leave, it's trespassing if you don't leave. Which makes more sense, Giving a warning for someone who refuses to leave? How is that going to get them removed?
