Wisconsin Sheriff Says He Will Not Enforce Stay-at-Home Order, Cites Constitutional Rights

Wisconsin’s Racine County Sheriff Christopher Schmaling indicated in a statement on Friday he will not enforce the state’s stay-at-home order, which Gov. Tony Evers (D) extended through May 26.

The sheriff provided an update to Racine County citizens on Friday, outlining his position on the enforcement of the Wisconsin Department of Health Services’ (DHS) public health emergency order.

While Wisconsin law gives both the governor and Wisconsin DHS “the authority to develop emergency measures and enforce rules and order to protect the public during a health crisis,” Schmaling emphasized that state law “does not have the power to supersede or suspend the Constitutional rights of American citizens.”

He urged the state’s DHS to “develop a workable plan that balances the safety of our citizens while at the same time acknowledging the fact that there is a way for business to operate even during the current health situation.”

“The overreaching measures taken by State government will have dire lifetime consequences for businesses, homeowners, and families,” Schmaling’s statement reads.

“I took an oath to uphold the constitutional rights of our citizens and I can not in good faith participate in the destruction of Racine County businesses or interfere in the freedoms granted to all of us by our Constitution,” he continued.

The cracks are starting. Are these tyrant governors going to hold on until there is news video of cops in riot gear, and tear gas attacking people?

so glad we live in a non city area- everyone is out walking, jogging, fishing, kayaking etc- yeah propel are ‘social distancing’ but still, they are out and about- making the best out of a crappy situation

Now here's the difference between me and a Democrat. If I had the morals of a Democrat I'd say, go ahead and hold on, the better to be rid of you when the people reach the ends of their tethers and rise up. But that's not the way my mind works. I'd rather they did the right thing to help preserve the lives, liberties and property of the people who are being hurt by this charade. Of course they're going to do what they're inclined to do, no matter what I think.

We all do what we can but there is huge difference between jumping in the car to going see Mom and a business opening. We need that to happen en mass. We are not idiots, we can social distance and open businesses.

Wisconsin’s governor just put out an order extending the shut down through memorial day weekend, which is sure to bankrupt many businesses that depend on summer vacation business. Tourism is Wisconsin’s largest business. This includes restaurants, bars, lodging, arts and craft shops. In one swipe of the pen, he ruined their business. Expect a third of the Wisconsin business’ to not exist in the fall. Many are dead now, just nobody knows it except the owners.

Biggest problem I see is with 2 states. NY where the gov thinks he is the second coming and Mich where the gov thinks she is a dictator.imo

We have a rogue Mayor in Denver. In today’s paper his “public health” dictators were talking about months more. If he doesn’t back down, I would expect businesses to look at leaving downtown for suburban office and industrial parks.

During the fires there was a lot of controversy as to whether they could force people to leave their homes during an evacuation. As I understand it, they cannot. Not it seems they can’t make me stay either.

Sounds like a song; should I stay or should I go?

Yeah, Evers is an annoying nerdy twerp isn’t he?

On March 20 he said there were no plans for a shutdown, then three days later he shuts it down until April 24. The DNC must have called sometime in those three days and given him his orders.

Now he’s extended it until the day after Memorial Day.

People are going to have to start ignoring him, lots of protesting may have an effect, or pressure from other states opening is going to have to change his mind.

I cancled a family reunion up ther on memorial day weekend. Local business’ will lose about 3,000 on me alone. Then think of all the weddings, boaters, and others. I would sit there on that Friday and watch hundreds of vehicals going up to door county. Good luck selling those nick-nacks and art now.
