The entire nation is under a declared state of emergency ... from the White House. His ability under law is absolute in such a situation.

I think it is instructive to recall Lincoln's actions. I agree with you given the makeup of the Senate and SCOTUS; there could be funding issues coming from the House. Most importantly, the 10th Amendment- as pointed out by others- does not give a state the right to interfere with civil liberties.
