BREAKING: State Dept. won’t support Hillary effort to avoid judge-ordered deposition

Per JustheNews, the State Department on Monday rejected Hillary Clinton’s effort to avoid depositions for herself and her former chief of staff in a lawsuit brought by the government watchdog organization Judicial Watch.

The former Secretary of State and her former top aide Cheryl Mills are seeking a writ of mandamus to avoid a judge’s order requiring their testimony in an open records case involving Clinton’s use of a private email server for government business.

“The government did not seek and thus does not support the extraordinary relief of mandamus due to the unique circumstances of this case,” reads the State Department’s response signed by multiple members of the Justice Department.

WashingtonExaminer reports the State Department declined to join former Secretary of State Hillary Clinton’s effort to convince an appeals court to let her dodge a judge-ordered sworn deposition about her use of a private email server and the 2012 Benghazi terrorist attack.

“The Court agrees with Judicial Watch — it is time to hear directly from Secretary Clinton,” U.S. District Court Judge Royce Lamberth ruled in March while also ordering former Clinton chief of staff Cheryl Mills to be deposed by the conservative watchdog.

Clinton’s legal team responded last month with an 83-page petition for a writ of mandamus, filed with the U.S. Court of Appeals for the D.C. Circuit, calling the district court ruling outrageous and asking a higher court to order the lower court to correct what Clinton’s lawyers saw as a deficient decision.

But the State Department, represented in court by Justice Department lawyers, declined to join Clinton’s legal argument on Friday.

“The government did not seek and thus does not support the extraordinary relief of mandamus due to the unique circumstances of this case,” DOJ appeals lawyer Mark Freeman told the higher court in a seven-page filing. “This is the rare situation in which discovery of a former Cabinet Secretary was not authorized for the impermissible purpose of probing internal government decision-making regarding official policy, but rather to focus on the impact on FOIA compliance of a former official’s unusual decision to use a private email server to systematically conduct large volumes of official business.”

Freeman said “the government’s decision not to seek mandamus here — after each of the discovery orders, not only the most recent — reflects the government’s consideration of the totality of the circumstances in this unique case.”

The legal team for Clinton said in March that reversing the order “is warranted because Judicial Watch’s impending depositions of Secretary Clinton and Ms. Mills are inappropriate, unnecessary, and a clear abuse of discretion.”

Clinton’s lead attorney, David Kendall, claimed, “Judicial Watch could not possibly show the extraordinary circumstances required to depose (or re-depose) former high-ranking officials regarding their reasons for taking official actions, and the court abused its discretion in finding otherwise.”

But Judicial Watch defended its efforts to the appeals court.

“The question … is whether Clinton purposefully routed the entire body of emails she sent and received during her four-year tenure at State, not just one email… [and] whether she did so to circumvent all FOIA requests concerning her emails,” Judicial Watch attorney Ramona Cotca said in a 63-page filing on Friday. “The reasons the District Court gave for its decision to authorize Clinton’s deposition — her state of mind when she decided to set up and use a private server, her awareness of her records management obligations, and her awareness of steps taken to prevent records managers and others from learning about her private server, among others — are directly related to answering these questions.”

Judicial Watch also said “questioning Clinton about whether she used a private server to evade FOIA may help answer whether State’s failure to disclose the Clinton email issue in 2014 or early 2015 harmed the district court’s integrity or abused its process.”

My information is she is already on record before hearings and in the public with statements that she will be under oath and questioned about.

If she refuses to answer, she can be held in contempt.

I don’t believe the 5th Amendment will protect her as she’s already on record with statements. If she tries pleading the 5th, it may implicate her as having lied before. Think about it, she makes public statements of her actions and whereabouts during an event possibly involving treason. She is questioned under oath and she pleads the 5th. The statement is already there in the public. She can’t refute it.

Suppose other witnesses are brought in to testify that her public statements were false. She’s already pled the 5th, she can’t counter these witnesses. It’s then possible a criminal referral can be made because of the other witness testimonies. At this point her lawyer is in a bind to defend her.

She can’t use “I don’t recall” about statements she’s already made.

She will be hard pressed to say she made a misstatement because that puts her in a situation that she may have lied before Congress. Her misstatements can be cross questioned against other related statements. She could be in danger that the entirety of all of her statements before Congress and in public were ‘misstatements’. Then with witness testimony, she is caught.

On top of just grilling her for past public statements, there may be previously undisclosed information regarding weapons and gold that Clinton could be questioned about. Witnesses to events involving the new information could come forward.

No doubt she’s slippery but a good prosecuting attorney can trap her.

Having Mills under deposition as an attorney also impedes her using the 5th as attorneys are held to a stricter standard. Attorneys can invoke the 5th but then their law licenses are at risk as they are expected to be forthcoming and truthful in a court of law before a judge.

So I see Clinton and Mills as in a panic and that’s why an 80-page Writ of Mandamus was filed as a last ditch effort to fend off jail time.. The only thing I would guess could be used now to escape justice is the pandemic. In the minds of these monsters, the pandemic must continue to the election and past it. It’s all they have even if the forces that be, say China, release another wave of virus to lock us all down.

Now let’s wander over to the pandemic topic a little to see how it’s related.

The pandemic is worldwide and is being used by actual Marxists (I know I sound like I’m from a different era to newbies to the power game) to launch genocide. There are voices that are getting the truth out.

I’m talking about a planned genocide going on right now in locked down South Africa. You can guess who the targeted genocide population is, yeah the ‘racists’, they are all racists in the minds of the ANC brainwashed govercrats and military garbed pot beliies. You know what I mean by ‘racists’. You know which ethnicity I am referring to. And then there are the Christian blacks who are trying to help, they’re at risk too.

Right now ANC ideological military units are patrolling the streets and shooting any ‘racists’ that dare even to step out on their verandas all in the name of the global pandemic. I am not kidding.

Now be smart, don’t be naive.

What’s happening in South Africa is just a peek into what is happening globally. It’s not about virus, it’s about rounding up the deplorables of the world.

If you’re laughing or smirking, it’s because you’re here in the US and insensitive to what others are going through in other parts of the world.

Consider that supply chains grind to a halt. Food becomes scarce, people begin to starve. Starving people are told the racists have hoarded all the food and are eating hearty inside their homes. They need to be attacked.

In the US, it won’t happen that way if Donald Trump has anything to do with it. The military here is under his command.

In the minds of Hillary and her faction, they must remove Trump no matter what. It’s life or death to them. They can only take him out like Boris Johnson is being taken out (pray for Boris!).

Hillary is a Marxist. Oh yes she is.

When you’re a Marxist and you’re in the party, life is good. The daughter of Hugo Chavez was left with billions and has a villa in Switzerland. Marxism is such a great scam. Dictate to the proletariat that everyone is equal, every one receives the same, salaries for taxi drivers and surgeons are the same.

If you have time, study how the Marxists came to power in Russia and other countries.

Here’s an outline:

1. War or armed conflict or tension leading to these conditions.
2. Food scarcity, starvation sets in.
3. Control of the press, the media, the narrative; turn people against other people.
4. Mobilize groups (like antifa or other), cause crackdown, martial law, lock down.
5. Revolution, upheaval in government, failure of existing power structure, replacement by groups representing ‘justice’.
6. Install and harden a new Marxist like power structure.
7. Elites at the top out of view living behind gated communities (I am not kidding, this happened in the USSR), everyone else locked down, restricted, no rights.

Hillary is bowing down for the Pandemic to save her.

Wow! I thot Judge Lamberth retired many years ago. He will be missed by patriots in the D.C. Circuit soon.
