Coronavirus: Judge orders release of six immigrant detainees, citing health risk

Six immigrant detainees who have underlying health issues that make them more vulnerable to coronavirus were ordered released by a federal judge Thursday, April 2, from the Adelanto ICE Processing Center in San Bernardino County.

The order from Judge Terry J. Hatter, a senior U.S. district judge, was in response to a lawsuit filed Monday by the American Civil Liberties Union Foundation of Southern California against officials with the U.S. Immigration and Customs Enforcement agency and the Adelanto facility.

The civil rights group argued that detainees at the Adelanto facility aren’t being given appropriate protection from coronavirus, and that continued detention and clustering of vulnerable people during the pandemic “creates not only a humanitarian crisis but also a constitutional one.”

The judge ordered the release of Jose Hernandez Velasquez, of Guatemala, Martin Vargas Arellano, of Mexico, Charleston Edward Dacoff, of Belize, Jose Robles Rodriguez, of Guatemala, Luis Lopez Salgado, of Mexico, and Paola Rayon Vite, of Mexico.

The detainees’ illnesses include asthma, diabetes and high blood pressure. One of them has an HIV infection.

“We’re thrilled that the court has ordered … the petitioners released,” ACLU attorney Minju Cho said Thursday afternoon.

Two weeks ago we were talking about prisons and my response was “weld them in and walk away”. I was chastised as a monster. But now we do have a problem. I talked to someone in the know about local prisons and they don’t know what to do. It ain’t really here too much so they aren’ pressed at the moment, but ethically how do you justify locking someone in a cell where they are almost certain to get a potentially life threatening illness. Just letting them out doesn’t seem reasonable but locking them down is sort of in humane. “Welding them in” MAY have been the most humane thing. If they riot and escape in droves we’ll just have to shoot them.

I can only hope the ongoing pandemic finally gets the USA to toss aside the ridiculous concept of Judicial Supremacy that infected our system of government years before CoVid-19 appeared.

This judge can say whatever the hell he wants about immigration issues, but he has no authority to dictate immigration policy. He should be ignored, and no - this should not be appealed or further litigated.

Can we sue him when the HIV guy infects another 20 people?

Lemme see now...I’m under a “stay at home” order here in CA and I’m not positive for anything. But this guy gets put back into circulation? Like he’s going to comply with medical emergency orders?

Release them into Mexico one month after repealing the Gun Control Acts of '34 and '68 and passing nationwide Castle Doctrine and Stand Your Ground laws that preempt all state laws to the contrary.

Then pass laws that allow lethal force to defend life and property.

Am I missing anything? That should level the playing field.

Well I guess there are no Americans here, that are having their civil liberties violated or anything since the ACLU has to serve illegal aliens.

No businesses or churches forced to close, no citizens arrested for going outside, nothing to worry about.

Hospitals will be so happy to finally have disease ridden people to serve now and lucky to have some to spread HIV.

What a gift to our great nation.

And since these dreamers are too ill to work, we Americans will be glad to take food from our tables so these fine contributors will have their medical treatments, food, clothing, housing, etc paid.

I mean, it’s not like there’s an economic crises or anything.
