I am of the opinion that President Trump should write an executive order requiring that going forward, ALL interviews conducted by FBI agents shall:
- be announced as an official FBI interview
- be video recorded;
- agents to identify themselves during the recording
- a copy provided to the interviewee within 48 hours;
- stored via tamper resistant means (crypto hash applied);
- and be subject to FOIA requests unless classified.
If the FBI agent fails to follow this procedure, then no notes of any kind or from any source should from the interview should be permitted as evidence.
I expect so many people are so well aware no jury is going to believe the FBI for a long, long time.
If interviews are all recorded - - and safely stored - - they can be pulled at needed. And it won't take a wit of space relatively ... Great suggestion.
If the FBI agent fails to follow this procedure, then no notes of any kind or from any source should from the interview should be permitted as evidence.
Absolutely and completely agreed. Additionally, without all of those in place, if I were on a jury, I'd consider any testimony by the FBI to be nothing but self-serving heresay.
